Reporting infringement
If you believe something on runmygig infringes a copyright you own or are allowed to act for, send a written notice that includes all of the following:
- your physical or electronic signature;
- a description of the copyrighted work you say is infringed, or a list if there are several;
- where the material is on runmygig, with a link to the Gig page or enough detail for us to find it;
- your name, mailing address, phone number and email address;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
When we get a complete notice, we remove or disable the material, and we tell the person who posted it and send them a copy of the notice. Someone who knowingly makes a false claim can be liable for damages.
Counter-notice
If material you posted was removed and you believe it was a mistake or misidentification, you can send a counter-notice to our designated agent that includes all of the following:
- your physical or electronic signature;
- a description of the material that was removed and where it was before it was removed;
- a statement, under penalty of perjury, that you believe in good faith the material was removed because of a mistake or misidentification;
- your name, mailing address and phone number, and a statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, if your address is outside the United States, any district where BTTRYZN LLC may be found), and that you will accept service of process from the person who sent the original notice or their agent.
When we get a complete counter-notice, we send a copy to the person who sent the original notice. We put the material back 10 to 14 business days after we receive the counter-notice, unless that person tells us first that they have filed a court action to stop the infringement.
Repeat infringers
We close the accounts of people who repeatedly infringe copyrights, in appropriate circumstances. We may also remove material or close an account after a single serious case.
